presenteert zich als de \u2018groenste haven van Europa\u2019 en beweert voorop te lopen in de energietransitie. In haar publieke communicatie belooft ze \u2018netto nul\u2019-emissies en \u2018groene\u2019 waterstofcorridors, gebaseerd op infrastructuur voor koolstofafvang en -opslag (CCS). Maar achter deze groene fa\u00e7ade schuilt een andere realiteit: de vlaggenschipprojecten van het Havenbedrijf Rotterdam zijn niet gericht op het afbouwen van fossiele brandstoffen, maar juist op het verlengen van hun verbruik. Dit wordt gefaciliteerd door royale overheidssubsidies, speculatief techno-optimisme en een structurele weigering om verantwoordelijkheid te nemen voor de uitstoot van haar industri\u00eble huurders.&nbsp;Door grootschalig in te zetten op CCS en waterstof, heeft het Havenbedrijf langdurige grondpachtcontracten afgesloten met grote vervuilers, waarmee het de fossiele infrastructuur voor decennia verankert. Hiermee plaatst het wederom bedrijfsbelangen boven het publieke belang en het welzijn van de planeet. Dit artikel ontrafelt de politieke keuzes achter het transitiebeleid van de haven en verkent hoe een werkelijk transformatieve energiestrategie eruit kan zien.<\/p>\n<\/div>\n\n\n\t<div  data-name=\"acf\/block-summary\" class=\"alignwide alignwide--narrow\">\n\t\t<div data-component=\"summary\" data-background=\"beige\" class=\"p-5 bg-beige md:p-8 lg:p-x-12 lg:p-y-10\">\n\t<h2 class=\"mb-2 text-lg font-bold md:mb-3 font-heading md:text-xl\">Samenvatting<\/h2>\n\t<div class=\"ll-wysiwyg child:text-sm md:child:text-base lg:child:text-md\">\n\t\t<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">De energietransitie van het Havenbedrijf Rotterdam leunt zwaar op technologie\u00ebn als koolstofafvang en -opslag (CCS) en waterstof, die niet zozeer gericht zijn op het uitfaseren van fossiele brandstoffen, maar op het beschermen van bedrijfsbelangen.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Het Havenbedrijf heeft zijn industri\u00eble huurders langlopende grondpachtcontracten verleend zonder hen te verplichten hun uitstoot te reduceren. Hierdoor kunnen deze bedrijven de energietransitie van de haven belemmeren.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Het Havenbedrijf weigert verantwoordelijkheid te nemen voor de decarbonisatie van haar huurders. De plannen voor CCS en waterstof, die royaal worden ondersteund door overheidssubsidies, zijn in de kern gericht op het verlengen van fossiele brandstofproductie. Daarbij wordt vertrouwd op kostbare technologie\u00ebn die gepaard gaan met aanzienlijke milieu- en sociale risico&#8217;s.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Nederlands belastinggeld wordt ingezet om fossiele-brandstofreuzen te beschermen tegen \u00e9chte klimaatmaatregelen, terwijl de maatschappelijke en ecologische kosten worden afgewenteld op gemeenschappen en ecosystemen. Op het eerste gezicht lijkt het aantrekkelijk: CCS zou het mogelijk maken om kooldioxide (CO<sub>2<\/sub>) uit industri\u00eble activiteiten af te vangen en ondergronds op te slaan. De haven speelt een sleutelrol in de Nederlandse handels- en energie-infrastructuur en fungeert als knooppunt voor de fossiele industrie in Noordwest-Europa en daarbuiten. Shell, ExxonMobil en BP behoren tot de 120 bedrijven die gevestigd zijn in het havengebied. Zij beheren elk raffinaderijen en petrochemische fabrieken met een verwerkingscapaciteit van honderden duizenden vaten olie per dag. Volgens onderzoeksgroep CE Delft waren de indirecte emissies van de waardeketen van brandstoffen en andere energie-inputs die in de haven worden verwerkt of doorgevoerd, in 2023 goed voor naar schatting 604 megaton CO<sub>2 <\/sub>\u2013 ruim drie keer zoveel als de totale jaarlijkse uitstoot van Nederland.&nbsp;<\/p>\n\n\n\n<p>De impact van de uitstoot van de haven is ook een zorg voor Rotterdammers. Luchtvervuiling door petrochemische bedrijven schaadt de gezondheid van bewoners en tast landbouwopbrengsten aan. In 2050 wil het bedrijf een &#8220;klimaatneutrale haven&#8221; zijn, conform nationaal klimaatbeleid.&nbsp;<\/p>\n\n\n\n<p>Toch moeten deze transitieplannen vooral worden gezien als een capitulatie voor de belangen van fossiele bedrijven. De centrale rol die CCS inneemt in de strategie van het Havenbedrijf wijst erop dat de plannen zijn afgestemd op het behoud van bedrijfsmodellen, niet op klimaatrechtvaardigheid of systeemverandering.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Wiens transitie?<\/strong><\/h2>\n\n\n\n<p>Voordat we ingaan op de details van de transitieplannen van het Havenbedrijf, is het belangrijk stil te staan bij de fundamentele beperkingen waarmee het bedrijf \u2013 en in het verlengde daarvan de Nederlandse staat en de gemeente Rotterdam als aandeelhouders \u2013 wordt geconfronteerd bij het ontwikkelen van deze plannen.<\/p>\n\n\n\n<p>De meest fundamentele beperking is ruimtegebrek. De hoge bevolkingsdichtheid in de regio rondom de Rotterdamse haven sluit fysieke uitbreiding vrijwel uit, terwijl de energietransitie, waaronder uitgebreide CCS-projecten, grootschalige nieuwe infrastructuur vereist. Op de lange termijn zou het havengebied zeewaarts kunnen uitbreiden met een nieuw landaanwinningsproject, maar dat levert binnen de vereiste termijn geen bruikbare ruimte op. Deze pachtovereenkomsten geven bedrijven generaties lang zeggenschap over het gebruik van die grond, wat ingrijpende transities in de weg staat.&nbsp;<\/p>\n\n\n\n<p>De pachtovereenkomsten tussen het Havenbedrijf en haar huurders kunnen juridisch op twee manieren worden gestructureerd, met elk hun eigen praktische gevolgen. Sommige overeenkomsten hebben de vorm van <em>erfpacht <\/em>&#8211; een specifieke categorie van grondgebruiksrechten in het Nederlands recht &#8211; waarvan de akten openbaar toegankelijk zijn via het Kadaster. Een voordeel van erfpacht is dat deze volgens de wet gebruikt mag worden als onderpand voor leningen, wat huurders van het Havenbedrijf kunnen aanwenden voor de financiering van hun faciliteiten in de haven. Andere pachtsconstructies worden op contractuele basis overeengekomen. Deze contracten kunnen niet als onderpand worden gebruikt, maar bieden het voordeel van vertrouwelijkheid. Deze wet bepaalt dat een panel van door de rechtbank aangewezen deskundigen de hoogte van de schadevergoeding vaststelt, inclusief de waarde van de te onteigende activa \u00e9n een schatting van de toekomstige inkomsten die verloren gaan als gevolg van de onteigening. Voor grote industri\u00eble bedrijven in de Rotterdamse haven kan deze vergoeding oplopen tot in de miljarden euro&#8217;s.<\/p>\n<\/div>\n\n\n<p>Deze uitzonderlijk gunstige voorwaarden beperken de onderhandelingsruimte van het Havenbedrijf. Het biedt fossiele bedrijven langdurige zekerheid, zonder dat daar bindende duurzaamheidsvoorwaarden tegenover staan.&nbsp;<\/p>\n\n\n\n<p>Bovendien zijn de contracten met de grootste vervuilers, zoals Shell, ExxonMobil en BP, vertrouwelijk. Dit gebrek aan transparantie is des te zorgwekkender gezien het grote belang van deze bedrijven voor het nationale energiebeleid. Ondanks deze geheimhouding is het redelijk om gefundeerde aannames te doen over de inhoud van de contracten, op basis van de beoordeelde erfpachtakten. Hoewel erfpachtakten en huurovereenkomsten juridisch verschillend zijn, vervullen ze in de praktijk grotendeels dezelfde functie: het toewijzen en reguleren van het gebruiksrecht van grond in de haven. Vanuit commercieel oogpunt, en gelet op het feit dat oliemultinationals doorgaans volledig inzicht hebben in erfpachtvoorwaarden van hun buren in de haven, ligt het voor de hand dat zij geen minder gunstige voorwaarden accepteren dan elders gangbaar is. Het Havenbedrijf gaf ook aan dat zij emissiereductiedoelstellingen aan de orde stelt tijdens onderhandelingen over nieuwe of verlengde leaseovereenkomsten en dat zij \u201cernaar streeft een actieplan op maat te maken&#8221; voor de top 20 uitstoters. In plaats van strenge eisen te stellen en prioriteit te geven aan een robuuste klimaatstrategie, probeert het Havenbedrijf de transitie aantrekkelijk te maken voor zijn huurders.&nbsp;<\/p>\n\n\n\n<p>De verantwoordelijkheid voor deze machtsdynamiek ligt niet enkel bij de bedrijven. Ook het Havenbedrijf en haar aandeelhouders zijn medeplichtig aan hun eigen zwakke onderhandelingspositie. In naam van concurrentiekracht zijn langdurige, eenzijdig gunstige contracten afgesloten. van het Havenbedrijf faciliteren bedrijfsbelangen<\/strong><\/h2>\n\n\n\n<p>Tegen deze achtergrond wordt duidelijk dat het Havenbedrijf in haar energietransitieplannen de belangen van grote olie- en gasbedrijven centraal stelt. Hoewel het Havenbedrijf stelt dat het in 2050 klimaatneutraal wil zijn, betreft dit enkel de eigen operaties. Het tempo van de infrastructuurontwikkeling wordt bovendien niet bepaald door de urgentie van de klimaatcrisis, maar door het moment waarop investeringen renderen voor energiebedrijven. De twee belangrijkste projecten zijn het Porthos CCS-project en de Delta Rhine Corridor.<\/p>\n\n\n\n<p>Het Porthos-project maakt gebruik van CCS-technologie om CO2 af te vangen bij industri\u00eble installaties en via pijpleidingen te transporteren naar een opslaglocatie onder de Noordzee. Kortom, CCS-technologie is volstrekt ontoereikend om de klimaatdoelstellingen van de haven \u2013 en van Nederland \u2013 te halen.&nbsp;<\/p>\n\n\n\n<p>Toch worden er miljarden euro\u2019s aan belastinggeld ge\u00efnvesteerd in CCS. Porthos fungeert daarbij als proefproject \u00e9n als hoeksteen van het nationale energiebeleid. Verontrustend is dat een groot deel van deze middelen niet wordt besteed aan de ontwikkeling of verbetering van de technologie zelf, maar aan het aantrekkelijk maken van de technologie voor vervuilende bedrijven. Het bevordert juist de verdere verankering van fossiele brandstofwinning en -productie in de komende decennia, ondermijnt daarmee de dringende noodzaak om fossiele brandstoffen uit te faseren. De risico&#8217;s van CCS maken het tot een gevaarlijke afleiding van de fundamentele systeemveranderingen die ons energiesysteem nu nodig heeft. Het toestaan dat CCS-aanbieders <a href=\"https:\/\/www.somo.nl\/facing-the-facts-carbon-offsets-unmasked\/\">compensatiekredieten<\/a> genereren, draagt slecht bij aan de uitbreiding en legitimatie van de aanjagers van de klimaatcrisis.<\/p>\n\n\t<\/div>\n<\/div>\n\t<\/div>\n\n\n\n<h4 class=\"wp-block-heading\">2. <em>&#8220;Een nieuw energiesysteem&#8221;.&nbsp;<\/em><\/h4>\n\n\n\n<p>De tweede pijler van het energietransitieplan van het Havenbedrijf richt zich op de omschakeling naar elektriciteit en waterstof als energiebronnen. Deze worden vaak gewonnen in het mondiale Zuiden, waardoor het risico bestaat dat historische ongelijkheden worden bestendigd. Die uitspraak wijst op een ontkenning van de potenti\u00eble schadelijke gevolgen, en laat fundamentele patronen van energieproductie en -consumptie ongemoeid.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>De verantwoordelijkheid afschuiven&nbsp;<\/strong><\/h2>\n\n\n\n<p>In tegenstelling tot de zelfverzekerde communicatie van het Havenbedrijf over haar energietransitieplannen, illustreren de vlaggenschipprojecten juist de dominantie van bedrijfsbelangen binnen diezelfde plannen. Publiek geld &#8211; afkomstig van de Nederlandse belastingbetaler \u2013 wordt ingezet om oliemultinationals decennialang ademruimte te geven om hun emissies onverminderd voort te zetten. Het waterstofenergiesysteem, dat door het Havenbedrijf wordt gepresenteerd als het toekomstige paradigma om aan de energiebehoefte van Nederland en Europa te voldoen, is bovendien extreem hulpbronintensief en in zijn huidige vorm volstrekt onrealistisch qua schaal. Om nog maar te zwijgen over de schadelijke gevolgen voor milieu, samenleving en klimaat.<\/p>\n\n\n\n<p>Deze tegenstrijdigheid wordt scherp zichtbaar in de manier waarop het Havenbedrijf de verantwoordelijkheid voor de uitstoot van haar huurders systematisch ontwijkt. Hoewel het bedrijf stelt de inspanningen van huurders tot emissiereductie te stimuleren, herhaalde het ook dat &#8220;het uiteindelijk de bedrijven in de haven zijn die de noodzakelijke investeringen doen om hun productiefaciliteiten aan te passen en hun directe en indirecte emissies te verminderen&#8221;. Kortom, de selectieve en zelfbeschermende benadering van CO2-boekhouding laat zien dat het Havenbedrijf, wanneer het er echt op aankomt, niet bereid is om zijn grootste fossiele huurders verantwoordelijk te houden.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Een andere energietransitie is mogelijk<\/strong><\/h2>\n\n\n\n<p>Op het eerste gezicht lijken de energietransitieplannen van het Havenbedrijf te beloven dat de klimaatimpact van de industrie in de haven kan worden &#8220;opgelost&#8221; met nieuwe technologie\u00ebn die uitstoot compenseren of verminderen, terwijl de ontwikkeling ervan economische kansen zou cre\u00ebren voor iedereen. Maar de techno-optimistische toon van deze plannen verhult een harde politieke keuze van het Havenbedrijf en haar publieke aandeelhouders. Gezien de onvermijdelijke ruimtelijke beperkingen \u00e9n de bewuste keuze om zich voor decennia te binden aan de belangen van industri\u00eble huurders via uitzonderlijk gunstige contractvoorwaarden, geven de huidige transitieplannen prioriteit aan bedrijfsbelangen boven het publieke belang. In dit kader speelt CCS een centrale rol in het verlengen van de levensduur van de fossiele industrie.<\/p>\n\n\n\n<p>De politieke rekensom die hieraan ten grondslag ligt, lijkt ingegeven door angst. Tussen de regels van strategiedocumenten door, waarin de noodzaak wordt benadrukt om klimaatambities te balanceren met een aantrekkelijk investeringsklimaat, sijpelt een duidelijke vrees door: de angst voor economische schade als gevolg van het frustreren van invloedrijke bedrijven. Die angst is niet ongegrond. Toch vereist de ernst van de klimaatcrisis, en de historische verantwoordelijkheid van Nederland om absolute emissies terug te dringen, dat het Havenbedrijf en de Nederlandse overheid deze angst onder ogen zien en koers durven te wijzigen.<\/p>\n\n\n\n<p>Er zijn genoeg maatregelen die het Havenbedrijf op korte termijn zou kunnen nemen om de energietransitie te versnellen, zonder direct in conflict te raken met huurders. Zo zou het de vage milieubepalingen in huurovereenkomsten met meer ambitie kunnen interpreteren en naleving afdwingen \u2013 bijvoorbeeld door emissiereducties binnen een bepaald tijdsbestek verplicht te stellen, en door huurkortingen of -boetes in te zetten om naleving te stimuleren (naast <a href=\"https:\/\/www.gasworld.com\/story\/co2-summit-rotterdam-gets-tough-on-carbon-reduction\/2153031.article\/\">de kleine korting<span class=\"sr-only\">(opens in new window)<\/span> <span class=\"icon inline-block ml-1 w-[0.875em]\"><svg width=\"24\" height=\"25\" viewBox=\"0 0 24 25\" fill=\"none\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M15.75 1.748a.75.75 0 0 1 .75-.75h6.75a.748.748 0 0 1 .524.213l.013.013c.132.135.213.32.213.524v6.75a.75.75 0 0 1-1.5 0v-4.94L8.78 17.279a.75.75 0 1 1-1.06-1.06l13.72-13.72H16.5a.75.75 0 0 1-.75-.75Z\" fill=\"currentColor\"\/><path d=\"M2.25 5.498A2.25 2.25 0 0 0 0 7.748v15a2.25 2.25 0 0 0 2.25 2.25h15a2.25 2.25 0 0 0 2.25-2.25v-9a.75.75 0 0 0-1.5 0v9a.75.75 0 0 1-.75.75h-15a.75.75 0 0 1-.75-.75v-15a.75.75 0 0 1 .75-.75h9a.75.75 0 0 0 0-1.5h-9Z\" fill=\"currentColor\"\/><\/svg>\n<\/span><\/a> op huurvergoedingen die zij nu al aan huurder geeft). Daarnaast zou de Nederlandse overheid \u2013 als aandeelhouder van het Havenbedrijf \u2013 een deel van de miljarden aan <a href=\"https:\/\/www.somo.nl\/nl\/nog-meer-belastinggeld-naar-grote-vervuilers-dan-gedacht-375-miljard-aan-fossiele-subsidies\/\">subsidies<\/a> voor fossiele energiegebruik of riskante technologie\u00ebn als CCS kunnen herori\u00ebnteren naar initiatieven die gericht zijn op het daadwerkelijk reduceren van absolute emissies en het uitfaseren van fossiele brandstoffen.<\/p>\n\n\n\n<p>Gelet op de urgentie van de klimaatcrisis zou de Nederlandse regering bovendien proactievere en krachtigere stappen moeten durven zetten. Een werkelijke transformatieve transitiestrategie zou betekenen: het volledig ombuigen van fossiele subsidies richting een vermindering van energieproductie en -verbruik, en het herinvoeren of versnellen van een nationale CO2-belasting, zoals voorzien in het <a href=\"https:\/\/www.government.nl\/documents\/reports\/2019\/06\/28\/climate-agreement\">Klimaatakkoord <span class=\"sr-only\">(opens in new window)<\/span> <span class=\"icon inline-block ml-1 w-[0.875em]\"><svg width=\"24\" height=\"25\" viewBox=\"0 0 24 25\" fill=\"none\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M15.75 1.748a.75.75 0 0 1 .75-.75h6.75a.748.748 0 0 1 .524.213l.013.013c.132.135.213.32.213.524v6.75a.75.75 0 0 1-1.5 0v-4.94L8.78 17.279a.75.75 0 1 1-1.06-1.06l13.72-13.72H16.5a.75.75 0 0 1-.75-.75Z\" fill=\"currentColor\"\/><path d=\"M2.25 5.498A2.25 2.25 0 0 0 0 7.748v15a2.25 2.25 0 0 0 2.25 2.25h15a2.25 2.25 0 0 0 2.25-2.25v-9a.75.75 0 0 0-1.5 0v9a.75.75 0 0 1-.75.75h-15a.75.75 0 0 1-.75-.75v-15a.75.75 0 0 1 .75-.75h9a.75.75 0 0 0 0-1.5h-9Z\" fill=\"currentColor\"\/><\/svg>\n<\/span><\/a>\u2013 om daadwerkelijk druk uit te oefenen op bedrijven die onvoldoende emissiereductie realiseren. Een transformatie van de haveninfrastructuur weg van fossiele brandstoffen is noodzakelijk om de klimaatdoelen van Nederland en Europa te halen. En hoewel de industrie regelmatig dreigt met desinvesteringen, is de werkelijke bereidheid van deze bedrijven om bij te dragen aan de kosten van een eerlijke transitie nog nauwelijks op de proef gesteld.<\/p>\n\n\n\n<p>Welke route ook wordt gekozen: het is tijd dat het Havenbedrijf en haar publieke aandeelhouders zich verzetten tegen de belangen van fossiele huurders in de haven. De economische gevolgen van het confronteren van de industrie met haar verantwoordelijkheid kunnen pijnlijk zijn \u2013 maar het nalaten om de klimaatcrisis aan te pakken zal onvergelijkbaar veel
